PuppyGal's Health Guarantee

If you are purchasing a puppy please print this for your records
If you purchase a puppy from me and a health issue arises within the first year which your
Vet and/or I believe could possibly be a life threatening genetic disease the following
are the options:
Return of the puppy to my possession and from that time forward I alone will be
responsible for discovery and treatment of disease. You will receive a letter from my Vet
giving the prognosis.
(1) If it is proven to be genetic, you will be given a refund of the purchase price of the
puppy and along with this you will be given the option of having the puppy returned to you
without being responsible for any medical expenses incurred while the puppy was in my
possession.
(2) If the problem is not deemed to be a genetic disorder, then you are responsible for
reimbursement of the medical costs. You must forfeit ownership of the puppy if you are
unable or unwilling to reimburse me for the medical expenses. Therefore if a puppy is
returned to my possession it's registration certificate or application must be signed
over to me at the time.
If you are unwilling to release the puppy into my possession, I will not be responsible
for any medical expenses incurred nor will I be part of the discovery process: I am very
much attached to all of my "babies" even after they become yours, therefore please don't
ask me to sacrifice my emotions unless you give me complete control of the process.
However if your Vet's prognosis is that the puppy has a genetic disease and this is confirmed
by a second opinion from a Vet of whom I approved in advance, I will refund the purchase
price of the puppy, upon receipt of written proof from both vets. You will at that time have
the option of returning the puppy to my possession, if you feel you are unwilling or unable to
continue it's care.
In addition, I will not be responsible for any motel or travel expenses incurred in conjunction with
and of the above situations.

03/09/04 Amendment: Any disputed concerning this Guarantee which can't be settled between
me and the new owners of a pup, must be settled in Arbitration instead of a Court Of Law.
All resulting hearings or legal action must be conducted in Hardeman County in the State
of Tennessee.
(This Amendment is the direct result of my being told about a group of con artists
operating out of a Northern state, who are buying animals of all descriptions in the Southern
part of the USA via the Internet, then immediately filing a Lawsuit in their home state,
claiming misrepresentation in regard to the puppies health. The sellers without the above
paragraph in their Health Guarantee are faced with the option of
hiring a lawyer to fight the lawsuit in a state 1200+ miles away and being present for the
hearings, etc. or refunding the money paid for the animal.)
